Dear Ms. Link and Mr. Gordon:
On March 26, 2013, you submitted a request to waive the establishment of an Academic Distress Commission for the Cleveland Municipal School District (CMSD). Your waiver request has been approved.
In accordance with R.C. 3302.07, 3311.76(C), and Ohio Adm. Code 3301-46-01, your exemption is granted through November 15, 2017, which is the date by which the State Superintendent must evaluate the CMSD’s performance in accordance with the provisions of HB 525 and submit a report to the Governor and the General Assembly. In addition, the annual reports required by R.C. 3311.741 shall also satisfy the requirements of Ohio Adm. Code 3301-46-01(E), which requires that a school district receiving an exemption submit annual reports. Finally, should the Cleveland Plan be terminated for any reason, this exemption will end.
This exemption is granted based, in part, upon House Bill 525, which was specifically intended to improve the academic performance of the CMSD. The Cleveland Plan represents a coordinated effort to improve student academic performance in the district. Accordingly, the creation of a separate state commission, the Academic Distress Commission, for the purpose of creating an academic recovery plan, would be duplicative and may interfere with the work already underway.
