3 new e-schools receive approval to open in 2013-14


The moratorium on internet- or computer-based community schools (e-schools) is lifted beginning with the 2013-2014 school year. Pursuant to Ohio Revised Code Section 3314.013 (B), beginning January 1, 2013, up to five new internet- or computer-based community schools (e-schools) may open each year, subject to a lottery if more than five new e-schools intend to open in the fall of 2013.

An e-school is an internet or computer based community school established under Chapter 3314 of the Revised Code, in which the enrolled students work primarily from their residences on assignments in non-classroom-based learning opportunities provided via an internet or other computer based instructional method that does not rely on regular classroom instruction. Governing authorities proposing new e-schools must enter into a Preliminary Agreement with a sponsor prior to March 15, 2013, adopt a community school contract by March 15, 2013, and execute (sign) the community school contract by May 15, 2013 to be eligible to open an e-school in the fall of 2013.

Anytime a Preliminary Agreement is created or a community school contract is executed, the department of education must be notified of that action within twenty-four hours. If more than five new e-schools notify the department of education that they have executed/signed a contract with a sponsor by May 15, 2013 to open an e-school in the fall of 2013, the department shall hold a lottery by May 31, 2013 to determine which five schools may open in the fall. The contract signed by the governing authority of any school not selected in the lottery shall become void by operation of law, but the governing authority members may enter into a new community school contract with a sponsor and repeat the process described above to open in a subsequent school year.
